Terms of Service

1. Acceptance of Terms

By accessing or using TuneWorks, you agree to these Terms of Service. If you do not agree, do not use TuneWorks.

2. Service Purpose

TuneWorks provides a motorsports garage, setup history, session notes, maintenance tracking, shop lists, Share Build, uploaded log workflows, ECU file utilities, AI-assisted analysis, Race Engineer chat, account billing, and connected MCP tools for signed-in app data. TuneWorks provides informational guidance only and does not tune, inspect, approve, or certify your vehicle.

3. No Professional or Safety-Critical Advice

Motorsport, vehicle modification, calibration, tuning, and vehicle operation involve inherent risks, including equipment failure, property damage, serious injury, and death. TuneWorks is not a substitute for professional engineering judgment, a qualified tuner or technician, trackside safety protocols, manufacturer guidance, inspection, maintenance, or driver responsibility. You must review and understand every output before applying it and are solely responsible for setup, calibration, maintenance, compliance, safety, and vehicle-operation decisions. Inspect and test changes with qualified personnel, appropriate safety equipment, backups, and recovery procedures in a lawful, controlled environment. Do not interact with TuneWorks while driving or operating a vehicle.

4. Accounts and Access

TuneWorks supports email-and-password and third-party sign-in methods. You are responsible for protecting your credentials, maintaining access to your account, and all activity under it. We may suspend access for misuse, abuse, security risks, payment issues, or policy violations.

5. Your Data and Sharing

You retain ownership of the vehicle records, setup notes, uploaded logs, ECU files, sessions, maintenance entries, shop lists, and other content you add to TuneWorks. By using TuneWorks, you grant us permission to process that content to operate, protect, support, analyze, and improve the service. You represent that you own or have permission to access, upload, modify, unlock, process, and share every file and other item you submit. Do not use TuneWorks to bypass access controls on files, software, vehicles, or systems you are not authorized to access.

If you use team features or Share Build, you are responsible for choosing what to share and who receives it. Share Build may email selected vehicle, setup, and session details to external recipients you choose.

6. AI and MCP Use

AI, analysis, Race Engineer, and MCP outputs may be incomplete, inaccurate, outdated, or unsuitable for a specific vehicle, calibration, event, driver, component, fuel, weather condition, or track condition. Outputs depend on the information you provide, available telemetry, assumptions, and third-party systems; they may omit relevant hazards or misinterpret uploaded data. TuneWorks does not guarantee a diagnosis, repair, performance gain, reliability, legal compliance, or safe outcome. You are responsible for independently validating all recommendations before acting on them and for keeping recoverable backups of original files and configurations. Connected MCP tools are limited to signed-in app data and do not provide admin access, billing administration, checkout, arbitrary SQL, raw database access, user impersonation, or unrestricted exports.

7. Billing, Subscriptions, and AI Credits

Paid subscriptions and AI credit purchases are processed through Stripe. Pricing, plan limits, features, credits, and availability may change over time. Unless otherwise stated at purchase, AI credits and subscriptions are provided for use within TuneWorks and are not transferable outside the service.

8. Acceptable Use

You agree not to:

• Use the Service for unlawful activity.
• Attempt unauthorized access, scraping, credential abuse, or service disruption.
• Upload malicious code or harmful content.
• Use TuneWorks to disclose another person's private information without permission.
• Reverse engineer, overload, or abuse web, API, OAuth, or MCP endpoints beyond intended product use.

9. Availability and Changes

TuneWorks is provided on an as-available basis. Features, plan limits, AI providers, analytics, integrations, MCP tools, and product workflows may change, be limited, or be discontinued at any time.

10. Disclaimers

To the maximum extent permitted by law, TuneWorks, its tools, processed files, and all outputs are provided “as is” and “as available” without warranties of any kind, express, implied, or statutory, including merchantability, fitness for a particular purpose, non-infringement, reliability, accuracy, completeness, availability, compatibility, or suitability for a specific vehicle or motorsports purpose. We do not warrant that a processed file will be accepted by, operate correctly with, or avoid damage to any ECU, component, or vehicle.

11. Limitation of Liability

To the maximum extent permitted by law, TuneWorks and its owners, personnel, and service providers are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss or corruption of data, failed or damaged files, ECU or vehicle damage, property damage, personal injury, death, downtime, event losses, lost profits, or claims by third parties arising from or related to TuneWorks or any decision made using its outputs. To the maximum extent permitted by law, our total aggregate liability for all claims will not exceed the greater of US $100 or the amount you paid TuneWorks during the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain warranty exclusions or liability limitations, so these provisions apply only to the extent permitted by applicable law and do not limit liability that cannot lawfully be excluded.

12. Assumption of Risk

You voluntarily assume the risks of using TuneWorks and of applying, flashing, importing, editing, or relying on any output or processed file. You are responsible for using appropriate safety procedures, qualified professional review, backups, validation, controlled testing, and recovery methods before operating a vehicle.

13. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless TuneWorks and its owners, personnel, and service providers from claims, losses, liabilities, and reasonable costs arising from your content, your vehicle or motorsports activity, your misuse of the service, your lack of authorization to access or modify submitted material, or your violation of these Terms or applicable law.

14. Termination

We may suspend or terminate access at our discretion for violation of these Terms, security issues, payment issues, abuse, or operational reasons.

15. Updates to Terms

We may update these Terms from time to time. Continued use after updates constitutes acceptance of the revised Terms.
